These general terms of use govern the use of the website that the City Council of Puerto del Rosario (hereinafter, the City Council) makes available to its citizens and businesses: www.puertodelrosario.org (hereinafter, the Site), owned by the aforementioned City Council with registered office at Calle Fernández Castañeyra 2, 35600 Puerto del Rosario.
The purpose of using the Site is to facilitate access to information and certain services made available to users by the City Council. Through its site, the City Council allows access to informational content about actions and services for its citizens from the Departments and Areas that comprise it; it allows them to communicate and interact as well as conduct transactions with the City Council by routing requests, petitions, etc. addressed to Public Administrations, as well as to submit claims or suggestions about the services made available to them.
Accessing and using the Site requires the user’s express acceptance of each and every clause set out in this Legal Notice, as well as each of the warnings or specific clauses established in the different sections on offers of municipal services presented on this page, which appear in the version published on the portal at the time of access.
The City Council reserves the right to modify at any time and without prior notice the format, configuration or presentation of the Site, as well as the conditions under which citizen services are presented.
If you do not accept the clauses established in this Legal Notice, you must refrain from accessing and/or using the services and/or content made available to you on the Site, proceeding to leave it.
The user undertakes not to use the Site to carry out activities contrary to the law, morals or public order and not to perform actions that harm the rights of the City Council, any other Public Administration or third parties, and in general to use it in accordance with the conditions established in this Legal Notice. Likewise, the user undertakes not to carry out advertising activities or commercial exploitation by sending messages using a false identity.
The City Council acts exclusively as the party responsible for the Site in its capacity as provider of an information service about its own services, and is not responsible for content that, in contravention of these general conditions, users may send or publish, the user being solely responsible for the truthfulness and lawfulness of such content.
The City Council may interrupt the Site service being used by the user and immediately terminate the relationship with the user if it detects use of the Site or any of the services offered therein that could be considered contrary to what is stated in this Legal Notice.
The entirety of this Site—text, images, trademarks, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, arrangement and presentation of its contents—is protected by Intellectual and Industrial Property laws and is owned by the City Council or, where applicable, by service providers who have granted the public entity rights of use. Its reproduction, distribution, public communication and transformation is prohibited, except for personal and private use.
The City Council does not guarantee that the contents are accurate or free of error or that the free use of them by the user will not infringe the rights of third parties. The good or bad use of this site and its contents is the responsibility of the user.
Making the Site’s content available does not imply the transfer of ownership or exploitation rights to the user, who undertakes to use it in accordance with the provisions set out in these conditions. Likewise, reproduction, retransmission, copying, transfer or redistribution—total or partial—of the information contained on the Site, whatever the purpose and the means used, is prohibited without prior authorization from the City Council or the holder of the corresponding intellectual and industrial property rights.

The City Council recommends carefully reading the terms of use and privacy policy of these sites. If you are interested in activating a link to any of the City Council’s pages, you must notify the City Council and obtain express consent to create the link. The City Council reserves the right to object to the activation of links to its website.
The City Council shall not be directly or secondarily liable for:

Any damages that may be caused to the user’s equipment by the use of the Site.
Cases in which a third party, breaching established security measures, gains access to messages or uses them to send computer viruses.
Any kinds of defects and flaws in the content transmitted, disseminated, stored or made available.
The lawfulness, reliability and usefulness of the content that users transmit by using the site or the services offered therein, nor their truthfulness or accuracy. The City Council does not control how users use the Site, nor does it guarantee that they do so in accordance with this Legal Notice.

By way of example and without limitation, the user shall be responsible for:

Carrying out any type of unlawful action, rights-infringing, harmful and/or damaging acts.
Safeguarding their username and password and not communicating them to third parties, in order to prevent identity theft or the provision of untrue or incorrect data.
Likewise, if the City Council becomes aware of fraudulent use of the services provided, with actions by users that infringe the rights of third parties or constitute illegal acts or acts against the City Council itself, it reserves the right to take appropriate measures to prevent their continuation and, where appropriate, to initiate the relevant legal actions.
This Legal Notice is drafted in Spanish and is subject to current Spanish legislation. For any type of dispute arising from the use of the services offered or from the Site’s own content, the parties, by accepting the clauses set out in this Legal Notice, shall submit to the competent Courts and Tribunals in each case.
